These Terms & Conditions (the "Terms") govern your use of Bellwether (the "Service"), a points-based prediction game operated by Nephrurus, an organisation based in Australia (the "Operator", "we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What Bellwether is

Bellwether is a game. You use in-game points (not money) to make predictions on questions. Points have no monetary value, cannot be bought, sold, redeemed, withdrawn or exchanged for cash or anything of value, and exist only inside the Service. Bellwether is provided for entertainment; it is not a financial product, a betting or gambling service, investment advice, or a real-money market, and nothing in it should be relied on as any of those.

2. Eligibility and your account

  • You must be old enough to form a binding agreement where you live, and in any case at least 16 years old.
  • You are responsible for the activity that happens under your account and for keeping your sign-in method secure.
  • Provide accurate information, and keep your display name and any image you upload appropriate and lawful.
  • One person, one account, used in good faith.

3. Acceptable use

When using the Service you agree not to:

  • break any law, or infringe anyone's rights, in the content you submit or the way you use the Service;
  • manipulate questions or points through collusion, multiple accounts, automation, or exploiting bugs instead of reporting them;
  • upload content that is unlawful, hateful, harassing, deceptive, or otherwise objectionable;
  • attempt to access, disrupt, scrape, overload, or reverse-engineer the Service or its infrastructure; or
  • impersonate anyone or misrepresent your affiliation with any person.

We may suspend, reset, or remove accounts, questions, predictions, or points that we reasonably believe breach these Terms.

4. Questions, predictions and points

We (and, where enabled, other players or administrators) may post questions, reveal answers, cancel questions, and reset points at our discretion, including where a question is ambiguous, compromised, or resolved incorrectly. Because points carry no monetary value, adjustments, resets, and corrections may be made at any time and do not entitle you to any compensation.

5. Feedback and suggestions

The Service includes a "We want your feedback!" box and other ways you may send us comments, ideas, suggestions, feature requests, or other feedback (together, "Feedback"). This clause is important, so please read it carefully.

  • Any Feedback you submit is given voluntarily and on a non-confidential basis. We are under no obligation to keep it secret.
  • To the maximum extent permitted by law, you assign to the Operator all intellectual property rights in your Feedback, and that assignment takes effect as you submit it. To the extent any right cannot be assigned, you grant the Operator a perpetual, irrevocable, worldwide, royalty-free, transferable, sub-licensable licence to use it for any purpose.
  • This means we may use, implement, modify, commercialise, and build on your Feedback, including ideas you suggest, without any obligation to you, and without any payment, credit, attribution, or accounting to you.
  • You confirm the Feedback is yours to give, that submitting it breaches no one else's rights, and, to the extent permitted by law, you consent to our use of it and waive any moral rights in it.
  • You keep the right to use your own ideas; this clause does not stop you from using what you already knew. It simply ensures that if you tell us an idea and we act on it, the result belongs to the Operator.

6. Our intellectual property

The Service (its software, design, branding, and content we provide) belongs to the Operator or its licensors. These Terms grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose, and nothing more.

7. Availability and changes

The Service is provided as a non-commercial project. We may change, suspend, or discontinue any part of it, including your access, at any time, with or without notice. We do not guarantee the Service will be available, uninterrupted, or error-free.

8. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that questions will resolve correctly or that points balances are accurate.

9. Liability

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Subject to that, and to the maximum extent permitted by law, the Operator is not liable for any indirect, incidental, or consequential loss, and because the Service involves no money and points have no monetary value, our total liability to you in connection with the Service is limited to resupplying the Service or, at our option, the minimum remedy the law requires.

10. Termination

You may stop using the Service and delete your account at any time from your account page. We may suspend or end your access if you breach these Terms. Clauses that by their nature should survive termination do so, including Feedback, intellectual property, disclaimers, and liability.

11. Governing law

These Terms are governed by the laws of Australia and the State or Territory in which the Operator is based, and you submit to the non-exclusive jurisdiction of the courts of that place.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the effective date above, and your continued use of the Service after a change means you accept the updated Terms.
